Online gaming web traffic up 11 percent, according to Media Metrix. Website, Internet, WSOP, Full Tilt Poker Online gambling sites have led the way in July, ranking high against other websites for highest gains in US web traffic for the month. The data, from comScore Media Metrix service, found that online gambling sites recorded a total of 13.4 million unique visitors in July, up 11 percent from the total for June. That gain could be partly attributed to interest in the World Series of Poker tournament, which "brought out the competitive side of Americans...prompting millions to visit online gambling sites to test their card-playing skills," comScore senior vice-president Jeff Hackett said. Poker Stars continued to lead all other gambling sites in the US in July, attracting 2.4 million visitors with an 8 percent rise from June, although Full Tilt Poker did its best to catch up, recording 2.3 million visitors on the back of a 14 percent rise. Other successful websites in July included Kingolotto Network with 2 million visitors, up 31 percent, and UltimateBet.com's online poker site with 1 million visitors, up 33 percent. Mall retail and toy retail sites matched online gaming's success with 11 percent rises in July, alongside travel information sites. Led by TravelAdNetwork, travel information sites posted an all-time high of 59.2 million unique visitors for the month.

A Greenfield lawyer who gambled away nearly $2.5 million of a client's money said at his sentencing Friday that playing the slots "was like the greatest drug there ever was," but that he hasn't gambled since his scheme was uncovered 22 months ago. Thomas H. Koch, 46, has been in treatment for a gambling addiction and attends Gamblers Anonymous meetings twice a week while working as a dishwasher. "Gambling isn't about the money," he told Circuit Judge David Hansher. "That's just the means to the end." Koch said he had tried to stop many times, but couldn't until he was caught. He said he's happy to be away from the casino, and he apologized to his client, family, friends, the court and the state bar. Prosecutors recommended four years, and Koch's attorney suggested a year in jail with release for work and therapy, and a stayed prison sentence to be served if Koch failed to meet conditions. Hansher credited Koch for quickly taking full responsibility for his crime once it was uncovered, for surrendering his law license and committing to treatment for his addiction. He agreed Koch probably didn't need prison to deter him from going back to the behaviors that have essentially ruined his life. But because of a need for general deterrence - a message to others that stealing so much money can't go unpunished - Hansher sentenced Koch to two years in prison, followed by four years of extended supervision. He must continue with Gamblers Anonymous and psychiatric treatment, and not enter any kind of gambling establishment anywhere, or gamble online. He also ordered Koch to pay $2,421,768.57 in restitution, even though Assistant District Attorney Kurt Benkley said Koch has no assets and likely will never pay the money back. Nearly two dozen people were in court to support Koch, and more than 30 submitted letters to the court. His wife said that even when he was gambling, he always was an outstanding, involved, caring father to their three sons, ages 7, 10 and 12. His sister said that in their family of eight children, they were expected to be self-sufficient and she was sad he felt he could never confide his problem to her. Since his arrest, the whole family's communication has improved, she said. "For the first time in his life, he seems calm," Kristin Koch said. Koch, a 1990 graduate of Marquette University Law School, operated his own law office at 3466 S. 13th St. Affiliated Computer Services, a Dallas-based company, works for medical insurers, checking to see whether their clients are suing to recover costs for their injuries when possible. ACS hired Koch in 2001 to pursue such cases in the Milwaukee area for ACS's insurance company clients. In 2007, a new litigation manager at ACS noticed Koch had about 360 open claims. When he failed to reply to her request for status updates, she found that about 270 had been settled, but that no proceeds had been forwarded to ACS. Company officials came to Milwaukee in October 2008, and Koch admitted his embezzling. Koch had told Hansher that in 2006 he signed up for Potawatomi's self-restriction list. He said he stayed away for two weeks, but when he returned no one turned him away, and that he collected on hundreds of jackpots after he was supposed to be banned. Hansher said Koch was not the first defendant he'd sentenced for stealing money that they lost at Potawatomi. While not excusing Koch's role, Hansher did say casinos "should be ashamed of themselves," for enabling gambling addicts like Koch.

Saskatchewan tops the country in gambling, leaving some to question what impact that might be having on the province. A recent Statistics Canada report, in 2008, the average Saskatchewan household spent more on gambling than any other province at $720 and Alberta second at $645. Quebec spent the least at $390. 'It means more revenue for the government in terms of health care, education … entertainment facilities,' said Ken Cheveldayoff, minister responsible for the Saskatchewan Gaming Corporation. Following the release of the Statistics Canada report, NDP deputy leader Deb Higgins repeated the call for a study to examine the effects of gambling on Saskatchewan residents and the extent the problem of addiction-based gambling exists in the province. 'We need to give this situation serious attention,' said Higgins. 'Behind those averages may lie patterns of problem gambling and gambling addictions that only a thorough study can reveal.' But Cheveldayoff said the Saskatchewan government has programs in place to monitor problem gambling. '(We) look at best practices model and have methods to monitor,' he said. But Craig Featherstone, Thorpe Recovery Centre executive director, said he wonders if the statistics are only based on tracked gambling, such as casino and lottery terminals. 'What I think they can't track is online gambling, which is becoming a bigger and bigger thing,' he said. 'There is online poker and online just about anything … there is all kinds of stuff.' Long-running dispute over legality of an innovative concept Nicholas Jenkins, the feisty lawyer and internet entrepreneur who has fought the Washington state government through the courts in defending his Betcha.com concept may have come to the end of the road. This week the Washington Supreme Court ruled that the founder of Betcha.coms unique proposition that betting was not gambling because losing players were not compelled to pay up still constituted illegal gambling. In a unanimous ruling, the court defined Betcha.com as an illegal bookie because it arranged bets and took a percentage of the action as a fee, reports Associated Press. The Bench said it did not have to decide whether optional payments by bettors would allow Betcha.com to technically escape the state's gambling restrictions. 'Under the statutory definition of bookmaking, it is immaterial whether or not Betcha users were engaged in gambling activity,' Justice Tom Chambers wrote for the court. With typical irreverence and humour, Jenkins wrote on his blog that the court's reasoning 'didn't pass the giggle test.' 'Never in a million years did I expect an opinion like this one,' Jenkins wrote. 'The court's error is so obvious that I wonder if a single justice even cracked our brief, let alone the Revised Code of Washington.' Washington state allows some forms of non-tribal gambling, including cardrooms that offer poker, blackjack and other games with relatively low stakes. Online gambling and bookmaking fees, however, are specifically outlawed in the state, with draconian criminal penalties for operators and players. Betcha.com allowed users to wager on just about anything - from sporting events, to political contests, to whether the moon would be full on a given night. Users couldn't bet more than $1,000 at any one time. Anyone wanting to offer or accept a bet had to transfer money into an account to back any losses, with the money held in escrow by Betcha.com. The company charged fees for offering or accepting bets, for proposing counteroffers, or for premium placement on the site. Bettors would submit claims after the event in question, but the losing bettor always had 72 hours to opt out of paying the debt. Failing to pay bets could negatively affect a user's reputation on the site, which was tracked with a number representing their 'honor rating.' The state Supreme Court ruling overturned an earlier state appeals court decision that Betcha.com hadn't engaged in gambling. Its decision affirmed the company possessed gambling records, a gross misdemeanor, and transmitted gambling information over the Internet, a lower-level felony.

Last week Senate Majority Leader Democrat Harry Reid suddenly changed his stance on online gambling, stating that he is willing to support online poker only. This did surprise many industry watchers who are closely following the moves of those who would have a say in the final outcome. Now an article published in the eGaming Review suggests a possible reason for the Senator’s shift in position. Senator Reid is from Nevada and would hold the interests of his constituency above all. The land casinos have a significant stake in the constituency. The American Gaming Association (AGA) represents the interests of the land casinos of Nevada. The eGaming Review article cites an interview with AGA president Frank Fahrenkopf in which he appears to have considerably softened his stand on online gambling. The article indicated that the AGA has started discussing legalized and regulated online gambling with those involved in drafting Barney Frank’s bill and with other agencies pushing for a regulated online gambling regime in the United States. However in the interview Fahrenkopf maintained that the official position of the AGA is that it is monitoring the situation. Several other interesting aspects about the frame of mind of the AGA were revealed in the article. The AGA considers the 2006 Unlawful Internet Gambling Enforcement Act (UIGEA) an unsuitable piece of legislation. Fahrenkopf criticized the lack of clarity in the UIGEA. He echoed Reid when he said that if they could get only poker out of the purview of the UIGEA they would be very satisfied. What came through in the interview was not an urgent desire to see online gaming become a reality but an acceptance of its inevitability. Therefore the priority of the AGA is to protect the offline interests of its member land casinos who have been in the doldrums since the economic turndown. The AGA is getting involved with online gaming legislation because it does not want the federal government to, intentionally or unintentionally, do something that harms the industry. Jay Leno's late night show clarified for some, the details of the proposed bill, as Frank brought home the reality that the government should not be deciding what honest people can do with their hard earned after tax cash. Frank also pointed out that there are revenues that can be had from taxing an entertainment that people are already enjoying in large numbers illegally. Frank asserted, "If you have some guy who wants to play poker on the internet, we say it’s illegal… We could make billions of dollars a year by making it legal and taxing it." The Federal Government could take in up to $42 billion over a 10-year period by introducing legal and regulated internet gambling in the United States. In addition, Frank pointed out to Leno, who was being controversial to the extreme, that amendments to the HR 2267 internet gambling bill only allows for debit cards and prepaid card payments and will not allow the use of credit cards. The proposed bill is in a tough scheduling position with Congress currently on recess until September 13th with a target adjournment of October 8th in advance of the general elections in the United States, which means that Congress will have 20 days to debate and decide the internet gambling issue before the elections begin.

The Communications Law Centre (CLC) has called for a tightening of Australian laws to more effectively prohibit access to online casino-style games like poker, blackjack and roulette. In a submission to the parliamentary inquiry on the prevalence of interactive and online gambling, the CLC said technology was enabling underaged and problem gamblers to place bets. Australia's current Interactive Gambling Act 2001 (IGA) regulated , where customers bet on events like horse racing and sports. online casino-style gambling, including table games and poker machines, as well as banning overseas companies from providing gaming services to Australians. But it was "largely ineffective" in prohibiting international gambling sites, the CLC found, as it provided "no meaningful way of enforcement". "CLC considers that the prohibition of international gambling sites has been largely ineffective as the rate of Australian access to such sites continues to increase over time." A former Islander who designs online gambling software says P.E.I. shouldn't get into internet gambling. The government is currently reviewing a proposal from Atlantic Lottery Corporation to set up an online gambling site in the region. Nick Abou Risk thinks Atlantic Lotto's plan to set up a regional site wouldn't be that successful. The former Bonshaw resident started playing poker with friends while attending the computer science program at University of Prince Edward Island. He now designs programs for a large internet poker site in Dublin, Ireland. Still an avid poker player, he's participated in 3,000 online tournaments and in face-to-face competitions. Abou Risk said it might be difficult to attract many people to a small regional site with what probably will be fewer players. "I'm a fan of letting people play with other players from all around the world. And if players are having a better experience, they're going to play more often," said Abou Risk. He understands why ALC would like to get a piece of the online action estimated to be about $50 million a year in the region. Abou Risk suggests an alternative. He recently designed a program for the government of France that requires internet sites to collect a tax from gamblers in that country. "They take a percentage of the pot, just like a live casino would do. That normally amounts to between five and ten per cent of the pot. So, in France they're taking two per cent of that cut," he explained. ALC or the P.E.I. government could not be reached for comment on this alternative to setting up a regional site in Atlantic Canada.

One thing is for certain in the political landscape of HR 2267 — there's a lot of potential money to be made, and the infighting within the gambling industry may destroy any and all support for it. As lawmakers appeared to be warming up to a bill that would provide national regulation of the online gambling industry and much needed tax revenue, recent Congressional testimony has online advocates and land-based casinos prematurely primed for war. Tom Malkasian, part owner and board member of the Los Angeles-based Commerce Casino (one of the largest poker casinos in the world), shocked the gambling industry with his vehement opposition to the legislation. He cited improper tax benefits to online entities, misleading revenue projections and the dismantling of existing federal and state gaming laws as his reasons. The Poker Players Alliance countered the testimony scornfully, accusing the Commerce of placing its “narrow corporate interests ahead of the interest of America's poker players.” It also hinted the opposition to HR 2267 was because the casino has aspirations to control California intrastate online gaming. Malkasian argues that the taxes imposed upon online gaming stand to be significantly less than those subject to land-based licensed casinos. Online advocates counter that more people are frequenting those casinos after getting their feet wet first with online games. The biggest draw to online gaming is convenience. It cannot compare to the excitement of the actual casino. Using poker as the barometer, online gaming does bring bigger land-based business. Twenty years ago, poker was a revenue drain. Now it's widely considered a revenue generator. Events such as the World Series of Poker enjoy record attendance, and the Commerce has benefited financially with increased numbers as well as a tour stop on the World Poker Tour. Malkasian also believes that illegally operating online sites (such as Pokerstars.com or FullTiltpoker.com, although he didn't name them directly) are in a better position to take advantage of HR 2267 and would quickly dominate the market. One thing is for certain in the political landscape of HR 2267 — there's a lot of potential money to be made, and the infighting within the gambling industry may destroy any and all support for it. As lawmakers appeared to be warming up to a bill that would provide national regulation of the online gambling industry and much needed tax revenue, recent Congressional testimony has online advocates and land-based casinos prematurely primed for war. Tom Malkasian, part owner and board member of the Los Angeles-based Commerce Casino (one of the largest poker casinos in the world), shocked the gambling industry with his vehement opposition to the legislation. He cited improper tax benefits to online entities, misleading revenue projections and the dismantling of existing federal and state gaming laws as his reasons. The Poker Players Alliance countered the testimony scornfully, accusing the Commerce of placing its “narrow corporate interests ahead of the interest of America's poker players.” It also hinted the opposition to HR 2267 was because the casino has aspirations to control California intrastate online gaming. Malkasian argues that the taxes imposed upon online gaming stand to be significantly less than those subject to land-based licensed casinos. Online advocates counter that more people are frequenting those casinos after getting their feet wet first with online games. The biggest draw to online gaming is convenience. It cannot compare to the excitement of the actual casino. Using poker as the barometer, online gaming does bring bigger land-based business. Twenty years ago, poker was a revenue drain. Now it's widely considered a revenue generator. Events such as the World Series of Poker enjoy record attendance, and the Commerce has benefited financially with increased numbers as well as a tour stop on the World Poker Tour. Malkasian also believes that illegally operating online sites (such as Pokerstars.com or FullTiltpoker.com, although he didn't name them directly) are in a better position to take advantage of HR 2267 and would quickly dominate the market. Licensed U.S. casinos that stood pat in areas of online gaming would have to build from the ground up.
